I.I. Publication Exposes Threat to Workers' Choices
Caldara: "No way to justify this attack on individual rights"

GOLDEN, Colo.- A new publication exposes the basic unfairness in robbing Colorado employees of a vital choice to keep their workplaces free.

 

The Independence Institute's "HB 1072: Empowering Union Leaders, Not Workers" by policy analyst Ben DeGrow highlights a key provision in Colorado's Labor Peace Act that is being threatened by a legislative proposal. The provision gives private sector workers some protection against being forced to join or pay fees to a union.
"There's no way to justify this attack on individual rights as something that's good for the people of Colorado," said Independence Institute president Jon Caldara. "Maybe it's good for a few who can't be bothered to actually persuade others to join their organization, but how is it good for workers to take away their right to make a choice?"
Under the law, a vote to approve the union contract needs majority support among ballots cast. But workers have to hold a separate vote to make everyone in the shop join or pay fees to a union. The second vote requires at least a majority of all affected workers to approve.
Since 1943, the Labor Peace Act has empowered employees to vote for a union contract without also having to force anyone else to support it, too.
"The separate election allows a pro-union worker to vote his conscience in such a way that he doesn't have to violate the conscience of his buddy who may not agree with him," DeGrow said. "It's this power to choose that gives the process some basic fairness."

House Bill 1072 in the Colorado General Assembly would eliminate the second election, meaning an all-union shop could be set up more easily. The bill already has passed the State House and is waiting to be heard in the State Senate.
